Probate
Probate is the process by which a person’s assets are distributed to creditors and heirs after their death. Sometimes during probate, conflicts arise about how the property should be distributed. For example, if there is no will, the heirs may need to be determined by Florida intestacy statutes. Or, a will may be contested by a family member who claims that there was undue influence, lack of testamentary capacity, or a mistake in the execution of the will that makes the will invalid.
